Beastify has made every effort to display the colours, images and of our products that appear at the store as accurately as possible. However, we do not guarantee that the colours, images of the products or designs on our products seen on our website will exactly match the actual product. We cannot guarantee that your device’s display of any colour will be accurate. Variations may occur due to factors such as the screen capabilities of customer devices, photography, lighting, image editing software, quality loss during image processing, and other external factors. Beastify is not responsible for, and will not guarantee, any differences in colour or appearance between the product images on the website and the actual items received.

Additionally, sizing guides are provided as general guidance, and slight variations in fit may occur due to manufacturing differences.

We reserve the right, but are not obligated, to limit sales of our products or Services to any person, geographic region, or jurisdiction. We also reserve the right to limit the quantities of any products or services, discontinue any product or services we offer at any time. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations or that any errors will be corrected. To the extent permitted by law, we disclaim all warranties, express or implied.

SECTION 6 – GRAPHIC DESIGNS AND EXCLUSIVE PROPERTY

All content on this site, including but not limited to text, graphics, designs, graphic designs, logos, icons, images, video clips, digital downloads, data compilations, designs, and software, is the exclusive property of Beastify or its content suppliers. This includes all proprietary designs and artwork featured on Beastify products, which are integral to our brand identity. Any unauthorised use, commercial use, reproduction, distribution or exploitation of these materials including but not limited to copying designs onto t-shirts or other merchandise, will result in immediate legal action to protect our rights and brand integrity.

The compilation, selection, arrangement, and presentation of all content on this site are also the exclusive property of Beastify.

You may not, without express written permission from Beastify, modify, copy, reproduce, republish, upload, post, transmit, distribute, sell, licence, or otherwise exploit any content from the site, including any Beastify original designs, for personal or commercial purposes. Any unauthorised use of the content or our designs is strictly prohibited and may result in legal action.

Trademarks, logos, service marks, and trade names displayed on the site, whether registered or unregistered, are the exclusive property of Beastify and/or its affiliates or licensors. Nothing in the Service or on the site grants you any right or licence to use any trademark, logo, design or service mark without express written consent from the owner.

Any infringement of Beastify’s intellectual property, including but not limited to unauthorised use, reproduction or distribution of our designs, including but not limited to graphic designs, will result in immediate legal action to protect our rights.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card details, to ensure that we can complete your transactions and contact you as needed.

You agree to indemnify Beastify from any claims arising from your submissions that infringe upon the rights of third parties.

SECTION 11 – OWNERSHIP OF CUSTOMER-SUBMITTED DESIGNS AND LIABILITY

When you submit a design to Beastify for custom t-shirt printing, you retain full ownership of the design. Beastify does not claim any rights of ownership over your submitted content. However, by submitting a design, you grant Beastify and its partners, a non-exclusive, royalty-free licence to use, reproduce, and modify the design solely for the purpose of printing and delivering the custom t-shirts as per your order.

You (the customer) represent and warrant that you (the customer) own or have the necessary rights to submit the design, and that the design does not infringe upon the intellectual property rights (including copyrights, trademarks, or other proprietary rights) of any third party. Beastify is not liable for any intellectual property violations that may arise from the designs you submit. If a design is found to infringe on third-party rights, all responsibility and liability rest with you, the customer, and Beastify reserves the right to refuse to print any design that violates these terms.

SECTION 12 – PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy, which complies with applicable data protection laws in India.

SECTION 13 – ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, there may be information on our site or Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers,  product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). This does not affect your statutory rights under applicable law.

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. SECTION 16 - PRODUCT IMAGES AND MODEL REPRESENTATION

All product images, lifestyle photos, and model images displayed on Beastify.in website are provided for illustrative and demonstration purposes only. Unless explicitly stated otherwise, images on the site are not representations or endorsements by any real person and do not imply any collaboration or promotion. Some images may be digitally created, enhanced, or AI-generated; such images are used solely to demonstrate product style and presentation and do not by themselves represent an actual, identifiable person.

Product images are intended to show general style and design and may not exactly reflect the colour, texture, finish, scale, or fit of the actual product you receive. Variations can occur due to device display settings and other factors. Beastify does not warrant that product images perfectly represent the delivered item.

If the actual product differs from what is shown, or you are otherwise dissatisfied with fit, appearance, or quality, you may return the item within 10 days of delivery provided the item is unused and all tags, labels, and original packaging are intact, in accordance with our Returns, Exchange and Cancellation Policy.

SECTION 18 – SHIPPING AND DELIVERY

We aim to deliver products within the estimated timeframes. However, delivery times are not guaranteed and may be affected by factors beyond our control. We are not liable for any delays but will endeavour to keep you informed of any significant changes.

SECTION 19 – FORCE MAJEURE 

Beastify shall not be held liable for any delay or failure to perform its obligations under these Terms of Service due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, acts of terrorism, acts of God, civil unrest, labour disputes, government regulations, interruptions in transportation or communications, pandemics, strikes, or any other unforeseen events. In such cases, Beastify will make reasonable efforts to resume operations as soon as possible.

You agree to indemnify, defend and hold harmless Beastify.in (Beastify), subsidiaries if any, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 21 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
